About the treatment of personal information in Foreign Non-Life Insurance Association of Japan

These guidelines provide for the thoughts and policy with regards to the protection of personal information and the basic policy of safety management regarding personal data in the Foreign Non-Life Insurance Association of Japan, Inc.( FNLIA ).

FNLIA shall, in view of the importance of protection of personal information and in order to progress social confidence in non-life insurance business, comply with the “ Act for protection of personal information “ (hereinafter referred to as the “ Protection Act” ), other relevant laws, the guidelines for protection of personal information in the financial sector ( hereinafter referred to as the “ Financial Services Agencies guidelines” ), other guidelines and the “ Guidelines of protection of personal information in non-life insurance companies “ in FNLIA which is a certified body for protection of personal information, and shall treat personal information adequately. With regards to safety management, FNLIA shall also abide by the “ Practical guidelines about safety management measures of the guidelines for protection of personal information in the financial sector “ of FSA and the “ Practical guidelines of safety management measures etc. of protection of personal information” in the member non-insurance companies of FNLIA which is a certified protection body for personal information and shall take adequate measures.

FNLIA shall thoroughly educate and give guidance to employees of the member companies in order to make personal information be treated adequately and shall review and improve these guidelines and adequate measures for treatment of personal information and safety management in FNLIA. FNLIA shall also handle complaints about treatment of personal information in the member companies, shall provide information to the member companies and shall exercise other necessary business in order to secure adequate treatment of personal information in the member companies by way of a certified protection body for personal information as certified in the section one, article thirty seven of the Protection Act.

Obtaining of personal information
FNLIA shall obtain personal information to such an extent as is required on business and by adequate and fair means.

Purpose of utilization of personal information
FNLIA shall not utilize obtained personal information beyond such an extent as is necessary for the following purposes.
FNLIA shall publish these guidelines which provide for the purpose of utilization in the homepage of FNLIA and shall provide brochures etc. showing these guidelines in the secretariats of FNLIA.
1) To make publicity activities and offers of information by publications and execute other various activities for promotion, enlightenment and researches of non-life insurance.
2) To make publicity activities and offers of information by publications and execute other various activities for safety and prevention of disasters, promotion of traffic safety, prevention of insurance crimes etc,. and promotion and enlightenment of knowledge of and researches of perception on health care.
3) To address with complaints and consultation about non-life insurance (and to address with complaints made against the member companies about handling of personal information and to offer information to the member companies.)
4) In addition, to do such activities as researches, studies, international activities, requests and proposals about non-life insurance business.

FNLIA shall not change the purpose of utilization beyond the extent that the purpose of utilization after the change is reasonably related to the purpose before the change. In case the purpose of utilization is changed, the contents of the change shall be advised to the said person or disclosed on the homepage etc.
In case personal information is treated beyond the extent that is necessary for the achievement of the purpose of utilization consent shall be obtained from the said person except for the cases stipulated in the section three, article sixteen of the Protection Act.

(3)Offer of personal data to third party
FNLIA shall, except for the following cases, not offer personal data to third party without consent of the said person. However, FNLIA may offer personal data to third party without consent of the said person, in such cases that handling of personal information is entrusted to the extent that the purpose of utilization may be achieved, that personal information is offered due to succession of business and that personal information is jointly utilized among the specified parties.
In compliance with laws and ordinances
In case the offer of personal information is necessary for the protection of human life, human body and personal property and it is difficult to obtain consent of the said person
In case the offer of personal information is particularly necessary for the improvement of public hygiene and the promotion of healthy growth of children and it is difficult to obtain consent of the said person
In case the offer of personal information is necessary to cooperate with execution of legal business entrusted by national government organizations, municipal bodies and agencies entrusted by these organizations and it may impair execution of the said legal business to obtain consent of the said person.
In the case of the procedure as provided for in the section two, article twenty three, of the Protection Act.

(4)Treatment of sensitive information
FNLIA shall, in compliance with the article six of the FSA guidelines, not obtain, utilize or offer sensitive information to third party, except for the following cases and other cases as provided for in the FSA guidelines.
In compliance with laws and ordinances
In case the offer of sensitive information is necessary for the protection of human life, human body and personal property.
In case the offer of sensitive information is particularly necessary for the improvement of public hygiene and the promotion of healthy growth of children
In case the offer of sensitive information is necessary to cooperate with execution of legal business entrusted by national government organizations, municipal bodies and agencies entrusted by these organizations

(5)Notice, disclosure, correction and suspension of utilization etc. of matters with regards to stored personal data as provided for in the Protection Act
Please make inquiry to the secretariats of FNLIA with regards to the requests concerning notice, disclosure, correction and suspension of utilization etc. of matters with regards to stored personal data as provided for in the Protection Act.
FNLIA shall confirm identification of the said person who makes the request and process the request upon receipt of the filled in form specified by FNLIA and shall then answer in principle in writing in due course. In answering the request for disclosure, FNLIA may charge a fee specified by FNLIA in respect of the matters disclosed.
In case FNLIA finds the information about the said person inaccurate as a result of necessary research conducted by FNLIA, FNLIA shall amend the information correctly in accordance with the finding.

(6)Outline of safety management measures of personal data
FNLIA shall take sufficient security measures such as development of handling regulations and development of scheme of practice with regards to safety management measures etc., in order to carry out safety management of personal data such as prevention of leakage, loss or waste of handled personal data etc.

(7)Window for inquiry
FNLIA shall address adequately and promptly with complaints and consultations etc. with regards to treatment of personal information.
